Consent to For Religious Freedom Claims Process & Arbitration
READ THE FOLLOWING TERMS VERY CAREFULLY. ALL VIEWERS, USERS OR OTHER PARTICIPANTS ACCESSING THE FOR RELIGIOUS FREEDOM SITE OR ANY MATERIAL FROM FOR RELIGIOUS FREEDOM AGREE TO SUBMIT A CLAIM TO FOR RELIGIOUS FREEDOM AND FOLLOW THE STATED INTERNAL CLAIMS PROCESS PRIOR TO TAKING ANY LEGAL ACTION. FURTHER IN THE EVENT A RESOLUTION IS NOT REACHED THROUGH THE INTERNAL CLAIMS PROCESS, ALL VIEWERS, USERS OR OTHER PARTICIPANTS ACCESSING THE FOR RELIGIOUS FREEDOM SITE AGREE TO SUBMIT TO BINDINGARBITRATION AT THE SOLE DISCRETION OF FOR RELIGIOUS FREEDOM. FOR RELIGIOUS FREEDOM (IN ITS SOLE DISCRETION) MAY ELECT TO REQUIRE MANDATORY, BINDING ARBITRATION AT ANY POINT. THIS MEANS THAT IF BINDING ARBITRATION IS ELECTED BY FOR RELIGIOUS FREEDOM FOR ANY REASON YOU AGREE TO SUBMIT ANY DISPUTE RELATED TO THE SITE OR FOR RELIGIOUS FREEDOM TO BINDING ARBITRATION RATHER THAN PROCEED IN COURT. YOU ALSO AGREE TO A JURY WAIVER AND A CLASS ACTION WAIVER, WHICH MEANS THAT YOU ARE AGREEING TO PROCEED WITH ANY DISPUTE INDIVIDUALLY AND NOT AS PART OF A CLASS ACTION. DO NOT USE OR ACCESS ANY PORTION OF THE SITE IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY.
Use of Site and Responsibility
By providing information, the user agrees to permit For Religious Freedom to post and use any information provided, either in whole or in part. For Religious Freedom is not responsible for how the information posted is used by others. Any complaints regarding the use of information by others should be directed to those using the information.
Use of Content
The information and services provided are only for personal, non-commercial use. No one is permitted to take any material from this website and reformat, repost, or redisplay it for any commercial or purpose. Storing, saving, downloading, reformatting or altering any photos or material from For Religious Freedom or this site for any purpose, by any person, is strictly prohibited. Any person(s) sharing or receiving photos or material in violation of this policy will be held strictly liable, jointly and severally, regardless of the method used to obtain the material or if the material was obtained directly from the site or through an intermediary source. Photos and material may only be accessed or used by directly visiting the website url where the information is located. Any person accessing, storing, saving, sharing, using, reformatting, reposting, redisplaying or distributing any photos or material in violation of this policy agree to pay a minimum fine of $10,000 per incident in addition to any other actual damages suffered or fines imposed by a court of law or through binding arbitration. An “incident” will be defined as each and every time a single photo or a portion of any single page is downloaded, shared, distributed, saved, stored, reposted or accessed. Each time a photo or portion of material from the site is accessed, shared or viewed shall constitute a separate incident. Any sharing or distributing of photos or material, or other violations of any of these terms, regardless of whether the material was originally accessed from the site or received from an outside party is strictly prohibited. Further, any effort made to identify, contact or harass any person contributing information based on the content provided is strictly prohibited unless expressly permitted by law. However, providing a link to an actual article is permitted for non-commercial purposes. The ability to post a link for non-commercial purposes should not be construed as conveying any rights to produce or otherwise make use of all or any part of the information provided. If for any reason a court of competent jurisdiction finds any portion or phrase of this “Use of Content” section to be unenforceable, all the remaining portions shall still be fully binding and shall have full force and effect.
Browsing and Community Participation
By viewing or accessing any information from the website, you understand and agree that the information made available is the work of individual authors and does not necessarily represent the views of For Religious Freedom or users and other contributors. For Religious Freedom assumes no responsibility for the suitability, completeness, or accuracy of any content provided. The viewer or user also understands that For Religious Freedom has not and cannot review all material made available through the website, or that is linked or linking to any part of the website. The viewer or user also understands that no such linking implies in any way that For Religious Freedom endorses or is affiliated with any other third-party site. You agree that For Religious Freedom maintains no responsibility or liability for any of the content accessed as well as any harm caused from any third-party site.

All materials on For Religious Freedom are the copyright of For Religious Freedom or are reproduced with the permission of another copyright owner. All rights are reserved. The material on this site may be retrieved solely for personal, non-commercial use. Downloading and storing any content, including photographs, for any reason is strictly prohibited. Violations of this policy may be prosecuted at the sole discretion of For Religious Freedom. No material may otherwise be modified, copied, published, broadcast or distributed otherwise in anyway, including photographs. For Religious Freedom and/or any other services or names of products provided by For Religious Freedom that are referred to on the site are considered to be included in this agreement when stating “For Religious Freedom.”
Information and Content Provided
By contributing content, the user affirmatively promises and asserts that it is not illegal, obscene, defamatory, threatening, infringing on intellectual property rights, invasive of privacy, or otherwise injurious and/or objectionable. The user agrees to take responsibility and sole liability for any information provided. For Religious Freedom does not agree to pre-screen or regularly review contributed content. However, For Religious Freedom has the right to remove (with or without notice) any content posted (in whole or in part) at any time that For Religious Freedom considers for any reason to be objectionable, violate these Terms and Conditions or to be outside the subject scope. While For Religious Freedom reserves the right to remove all or part of any submission, it maintains no obligation for doing so. For Religious Freedom may terminate any account, with or without notice, at any time for any reason.
Completing the registration process may be required to create a For Religious Freedom account. By submitting any content, you (the user) represent and warrant that all information provided is current, accurate, and complete, and that you will maintain the accuracy and completeness of this information on a prompt, timely basis. For Religious Freedom reserves the right to terminate any For Religious Freedom account or restrict access to any For Religious Freedom account, or to delete any content posted through any For Religious Freedom Account, with or without notice, at any time (with or without reason).
After registering for For Religious Freedom, one or more passwords may be received or established. The user is solely responsible for maintaining the confidentiality and security of password(s) and the users account(s). The user understands and agrees that they are fully responsible for all actions and postings made from their For Religious Freedom account. Any accounts created are not transferrable. The user agrees to notify For Religious Freedom immediately if they become aware of any unauthorized use of their For Religious Freedom account.
For Religious Freedom License
The user agrees to grant For Religious Freedom a limited, non-exclusive, worldwide, royalty free license to any content provided. By contributing content to For Religious Freedom, permission is granted for For Religious Freedom to use the content provided in any manner related to the services provided, including, but not limited to, the right to copy, transmit, publicly display, distribute, allow others to print, print, publicly perform, edit, translate, reproduce, reformat digital and non-digital content, and/or to incorporate it into a collective work.
Copyright and Trade Mark Laws
Any person or user that provides any material for inclusion on For Religious Freedom is responsible for ensuring that all material does not violate any other parties’ copyright or other proprietary rights. The user is also responsible for ensuring that the content does not otherwise violate any law or applicable For Religious Freedom policy. As part of For Religious Freedom’s general right to remove material, For Religious Freedom also reserves the right to (in its sole discretion) delete or make inaccessible files that may contain any material that violates law, or applicable policy, or the rights of third parties at any time.
User Warranties & Representations
By posting or providing any content, the user represents and warrants that the user has all rights, title, and interest to the posted content. This includes, but is not limited to, any consent, release, clearance authorization, or license from any third party (this may include, but is not limited to, any release required related to the rights of privacy or publicity) necessary to submit, provide, upload, post or input the content. The user further agrees that by posting such content no infringement of any patent, trademark, trade secret, copyright, right of privacy, or right of publicity, or moral rights, is made. The user further warrants that no infringement of any intellectual property right that may be recognized by any jurisdiction of any person or entity is made. The user also warrants that no information provided constitutes any breach of any agreement with any other entity or person. The user also represents and warrants that no software or other mechanism that sends repeated queries or otherwise sends automated responses or queries to For Religious Freedom will be utilized. The user represents and warrants that all information provided is truthful and that the user is who they say they are and that they have not submitted fictitious, false or inaccurate information about themselves. The user warrants and represents that all information contained in the posted content is true and is the users own work and that the user is authorized to submit the content. The user warrants and represents that the posted content does not contain any harassing, libelous, threatening, false, offensive, obscene, defamatory, or pornographic, material, as well as any other material that may violate any other applicable law or regulation. The user agrees that they will not knowingly or with intent defraud, or provide material or misleading information. The user represents and warrants that the content supplied further does not violate any terms and conditions.
The user acknowledges and agrees to indemnify and hold For Religious Freedom, their affiliates, employees, officers, and agents, harmless from any demand, claim or assertion made by any party due to or arising from or out of use of For Religious Freedom or any related services provided. The user acknowledges and agrees to indemnify and hold harmless For Religious Freedom and the above stated associated individuals from any violation of these terms by the user or made utilizing the user account whenever so requested by For Religious Freedom. In the event that current contact information is not provided, the user agrees to assume any liability, expense or harm caused from failing to provide current information. This includes any claims made based on any intellectual property infringement or by any other person or entity based on any right. The user agrees to pay for any attorney fees incurred by For Religious Freedom due to violations claimed to be made by the user or made utilizing the user’s account.
Termination & Service Provided
For Religious Freedom disclaims any responsibility or liability for the timeliness, availability, security or reliability of the services provided as well as any software provided through For Religious Freedom. For Religious Freedom reserves the right to suspend, change, or discontinue any service or access to any services without notice at any time and without any liability.
Waiver, Limitation of Liabilities & Disclaimer of Warranty
Complaints, Copyright Infringements, Notice and Takedown Procedure
Content on For Religious Freedom is provided by users and the user agrees to take sole responsibility for the information provided, including verifying and ensuring that the content provided does not infringe on copyright requirements. For Religious Freedom, however, makes a point of responding to clear complaints if there is a valid legal basis and notices of alleged copyright infringement if they comply with the United States Digital Millennium Copyright Act (DMCA) and the stated For Religious Freedom Copyright Claim Policy. The following outlines the information required in any claim or notice of copyright infringement. As previously stated, all users agree to comply with applicable copyright laws. If For Religious Freedom receives proper notice of a claimed copyright infringement, however, For Religious Freedom will respond to such notices by conducting an investigation and disabling any information that is clearly shown to violate United States copyright laws. Content that is associated with a properly claimed infringement may be removed or the user account may be disabled at the sole discretion of For Religious Freedom. For Religious Freedom, as part of the investigative process, will make a good-faith effort to contact the owner or administrator of the content that allegedly created a copyright infringement or caused a valid, legal claim to be filed.
If any dispute arises related to For Religious Freedom, the site, or any individual associated with the site, whether a copyright infringement or otherwise, you agree to fully comply with the following claims process prior to seeking any other legal remedies.
To file a claim, including a notice of copyright infringement, you must:
- Send a written communication to PO Box 50146, Provo, UT 84606 AND
- Send an email notification to firstname.lastname@example.org.
The following information must be provided for the claim to successfully be submitted and reviewed. Please note that you will be held liable for any damages, including attorney fees and costs, if you materially misrepresent any material provided, including a misrepresentation that material is infringing on your copyright(s). You will also be liable for any damages, including attorney fees and costs, if the claim is found to have no valid legal basis, spurious, or is made with apparent intent to defraud or harass. If submitting a copyright infringement, make sure you are the proper copyright holder. You may wish to consult an attorney. To submit a valid claim, please provide the following information (including the corresponding section numbers).
- State your full legal name, mailing address, phone number and email address.
- Identify the subject of your claim. Please state if it is an alleged copyright infringement.
- Describe your claim.
- Provide a statement indicating your standing or your authority to represent the person or entity with standing.
- Specifically cite any laws (with a full citation) that you believe have been violated.
- Describe any efforts made on your own to mitigate the current problem.
- Provide all evidence that exists supporting your claim.
- If a copyright infringement is alleged, provide the following information:
- Identify in detail the copyrighted work that you believe has been infringed upon, include the: 1) name of the work, 2) author name,3) a citation (if applicable) and 4) a url where the information can be viewed if available online.
- Please attach the copyrighted work that you claim is being infringed upon.
- Please provide any evidence indicating that you are the owner of the copyrighted work.
- Please provide a description indicating how the use of the stated material violates copyright laws.
- List any specific laws that you are asserting were violated.
- Please state the exact material that you are claiming is infringing on your copyright, including: the a) url, b) author, c) title of the work, and d) the exact portion of the work that is alleged to create a copyright infringement.
- Include the following statement in your description of the copyrighted work: “I assert that I am the copyright owner and the complained use of material is not authorized by the copyright owner, its agent, or the law.” Also include the following statement, “I swear, under penalty of perjury, that the information in this notification is accurate, and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
- Sign the document.
- Send BOTH written and email notification to the physical address and email address listed above.
Any user providing information that results in a claim being filed, or the provider of content that allegedly infringes on a copyright, may also make a counter claim within 20 days of the original claim being filed.
For a user to file a counter claim with For Religious Freedom, the user must:
- Send a written communication to PO Box 50146, Provo, UT 84606 AND
- Send an email notification to email@example.com.
The user will be liable for damages (including costs and attorney’s fees) if they materially misrepresent any information provided. Accordingly, you may wish to first contact your attorney.
Upon receipt of a counterclaim, For Religious Freedom will promptly provide the person who provided the original claim with notification and a copy of the counter claim. For Religious Freedom will then review the information provided and provide a written determination within 20 days. If the person filing a claim is unsatisfied, they may file an appeal within 10 days of receiving a determination from For Religious Freedom. If the person filing a claim is still unsatisfied with the result of the appeal, they may send written notification to For Religious Freedom expressing intent to file a legal claim. The person filing the claim agrees to then wait 30 days for For Religious Freedom to respond and provide notification if binding arbitration is required prior to filing any legal claim. The user agrees to file any legal claims in a state or federal court located in the State of Utah, Provo jurisdiction.
